TOWING & VEHICLE LOGISTICS SERVICES

1. Introduction
Tochanwala Assistance (“Tochanwala”, “we”, “us”, “our”) provides vehicle towing, recovery, and vehicle movement/logistics services including but not limited to car towing, bike towing, flatbed towing, hydraulic towing, recovery, and vehicle delivery services. These Terms & Conditions govern your access to and use of our website, communication channels, and services.
By booking or using any service provided by Tochanwala, you agree to be bound by these Terms & Conditions.

2. Nature of Services
Tochanwala primarily operates as a towing and vehicle logistics service provider. Certain services may be fulfilled directly by Tochanwala-owned fleet or through third-party vendors/partners depending on availability, location, and service requirements.
Services offered include, but are not limited to:
Bike / Motorcycle / ATV Bike / EV Bike Towing
Hydraulic Towing
Flatbed Towing
Zero Degree Flatbed Towing
Closed Container Truck Transportation
Vehicle recovery and vehicle delivery/logistics services
All services are transportation-only services. Tochanwala does not provide mechanical repair, diagnostics, roadside repairs, or vehicle maintenance services.

3. Booking & Service Acceptance
Booking can be done via phone, website, WhatsApp, or any other communication channel provided by Tochanwala.
Service acceptance is subject to:
Availability of suitable towing equipment
Vehicle condition and location accessibility
Safety considerations
Tochanwala reserves the right to refuse or cancel a booking if:
Incorrect or incomplete information is provided
The location or vehicle condition poses safety risks
Customer behavior is abusive, threatening, or non-cooperative

4. Pricing & Payments
Charges depend on distance, vehicle type, towing method, recovery complexity, waiting time, night charges, interstate movement, and special equipment if required.
Prices communicated at the time of booking are indicative and may change if actual conditions differ from the information shared by the customer.
Additional charges may apply for:
Waiting time
Special recovery equipment
Toll, parking, permits, interstate taxes
Night or emergency operations
Payments must be made as instructed (advance / on completion). Non-payment may result in service refusal or legal recovery.

5. Customer Responsibilities
The customer agrees to:
Provide accurate details regarding vehicle condition, location, documents, and destination.
Ensure availability of:
Valid vehicle documents
Keys (unless informed otherwise)
Authorized person for vehicle handover
Remove all personal belongings and valuables from the vehicle before towing.
Inspect and acknowledge the vehicle condition at handover and delivery.
Tochanwala is not responsible for loss of personal items left inside the vehicle.

6. Liability & Limitation of Responsibility
Vehicles are handled with reasonable care; however, towing, recovery, and transportation involve inherent risks.
Tochanwala shall not be held responsible or liable for any damages, scratches, dents, mechanical issues, electrical issues, or consequential losses occurring during transit, towing, loading, unloading, or recovery operations, including damages caused due to vehicle condition, low ground clearance, modifications, prior damage, or recovery complexity.
Tochanwala shall not be responsible for any pre-existing damages or defects in the vehicle.
Recovery operations (off-road, accident, stuck vehicles) may result in unavoidable damage. The customer agrees that such risks are entirely at the customer’s responsibility.
Tochanwala shall not be liable for loss of income, loss of business, delay damages, or indirect or consequential losses.
Maximum liability, if any, shall be strictly limited to the amount charged for the specific towing or transportation service.

7. Third-Party Vendors
Certain services may be fulfilled by third-party towing operators.
Tochanwala acts as a facilitator and coordinator in such cases.
While reasonable diligence is exercised, Tochanwala shall not be liable for acts or omissions of third-party vendors beyond coordination of service.

8. Waiting Time & Additional Charges
Free waiting time of up to 1 (one) hour is included from the time the towing vehicle reaches the pickup location.
Waiting charges beyond the free period shall be applicable as follows:
₹300 per hour (or part thereof) for Bike / Motorcycle / EV Bike Towing and Hydraulic Towing
₹500 per hour (or part thereof) for Flatbed Towing, Zero Degree Flatbed Towing, and Closed Container Truck
Waiting time caused due to police formalities, document issues, customer unavailability, incorrect location details, or any external dependency shall be chargeable.

9. Interstate & Legal Compliance
For interstate towing:
Customer must arrange and provide necessary permits and documents.
All taxes, tolls, penalties, or authority charges are payable by the customer.
Tochanwala shall not be responsible for vehicle detention by authorities.

10. Cancellation & Refund Policy
Cancellation before dispatch may attract cancellation charges.
Once the towing vehicle is dispatched, cancellation charges or full service charges may apply.
Refunds, if applicable, will be processed within a reasonable time after deduction of applicable charges.

11. Force Majeure
Tochanwala shall not be held responsible for failure or delay in services due to events beyond reasonable control including but not limited to natural calamities, floods, riots, strikes, government restrictions, or severe weather.

12. Conduct
Tochanwala reserves the right to refuse or discontinue service if the customer or occupants engage in:
Abusive, threatening, or violent behavior
Misrepresentation of facts
Unsafe instructions or interference during towing

13. Privacy
Customer information is collected solely for service fulfilment and operational communication. Information may be shared with vendors, drivers, or authorities strictly on a need-to-know basis.

14. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Navi Mumbai, Maharashtra.

15. Amendments & Future Services
Tochanwala reserves the right to modify these Terms & Conditions at any time without prior notice. Updated terms shall be effective immediately upon publication.
Tochanwala may, in future, introduce towing packages or bundled service offerings. Such packages, if launched, shall be governed by separate package-specific terms communicated at the time of purchase.
Use of Tochanwala services does not require any mobile application. Services may be booked via phone, website, WhatsApp, or other communication channels as decided by Tochanwala. Tochanwala is not obligated to provide or maintain a mobile application.
